Nightfall is developed and operated by Monty Works ("Developer," "we," "us"). By downloading, installing, or using Nightfall ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

Nightfall is an iOS ambient sound mixer. Each sound is controlled by a single intensity slider — raising it makes that sound more present in the mix. The App includes a sleep timer that fades audio out gradually, background playback with lock-screen controls, and saved scenes.

The free tier includes the full five-sound mixer at full intensity range, one saved scene, and a sleep timer of up to 60 minutes. Nightfall Pro, a one-time purchase, adds overnight fade durations, per-sound character controls, unlimited saved scenes, and an expanded sound library.

Nightfall Pro is a one-time, non-consumable in-app purchase — not a subscription. It is processed by Apple's App Store and validated through RevenueCat, the Developer's purchase-management provider. The unlock is tied to your Apple ID and can be restored on any device signed in with the same Apple ID using Restore Purchases in the App's settings or paywall.

The Developer does not process payments directly and has no access to your payment information. Refund requests are handled by Apple at reportaproblem.apple.com. For details on the limited purchase data RevenueCat receives, see the Privacy Policy.

Nightfall is a relaxation and ambience application. It is not a medical device, does not provide medical advice, and does not diagnose, treat, cure, or prevent any condition, including sleep disorders or anxiety disorders. If you have concerns about your sleep or health, consult a qualified professional.

All ambient audio in the App was produced by the Developer using licensed generative audio tooling and is the property of Monty Works. The App grants you a personal, non-transferable license to play this audio within the App. You may not extract, redistribute, resell, or use the audio outside the App.

You agree not to reverse-engineer, decompile, or extract the App's source code or bundled audio, circumvent the App's purchase gating, or use the App for any purpose that violates applicable law.

The App — including its design, source code, audio content, and branding — is the intellectual property of Monty Works. Users may not copy, modify, distribute, or create derivative works of the App or any portion thereof.

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted or error-free, or that any particular soundscape will produce any particular outcome, including falling or staying asleep.

To the fullest extent permitted by applicable law, Monty Works shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Our total liability for any claim related to the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

You may discontinue use of the App at any time by deleting it from your device. Deleting the App removes locally stored data; your Pro unlock remains associated with your Apple ID and can be restored on reinstall.

The Developer may update these terms periodically. When changes are material, the effective date at the top of this page will be updated. Continued use of the App after changes take effect constitutes acceptance of the revised terms.

These terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
